On this page, we provide information about the general criteria and procedures that SAL applies when directly awarding contracts in the areas of advertising, media, and communications in accordance with Article 25 of the European Media Freedom Act (EMFA). The criteria for public tenders pursuant to the Federal Public Procurement Act are published separately in the respective procurement procedure.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ba8bdee elementor-widget__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"ba8bdee\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Purpose and Scope<\/strong><\/p><p>The following principles apply to contracts and collaborations within the scope of Article 25 of the EMFA. These may include, in particular:<\/p><ul><li>Advertisements and promotional placements in print, online, radio, or television media<\/li><li>Advertising and informational campaigns on online and social media platforms<\/li><li>Employer branding initiatives and the promotion of job openings<\/li><li>Media collaborations and editorial partnerships<\/li><li>Production and provision of media content, such as video, audio, or editorial pieces<\/li><li>Other goods and services provided by media service providers or online platform providers<\/li><\/ul><p>\u00a0<\/p><p>SAL will assess on a case-by-case basis whether a specific contract falls within the scope of the EMFA. The applicable public procurement regulations, SAL\u2019s general terms and conditions of purchase, and SAL\u2019s internal procurement guidelines remain unaffected by this.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e732dd9 elementor-widget__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"e732dd9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Principles of Contract Award<\/strong><\/p><p>A key principle at SAL is the comparability of bids. This is achieved through predetermined, transparent, objective, proportionate, and non-discriminatory criteria. The specific procedure is determined based on the nature, scope, complexity, and value of the contract.<\/p><p><br \/>In the course of a direct award, SAL may invite suitable companies directly to submit non-binding bids, conduct market research, or give interested companies the opportunity to express their interest in collaborating.<br \/>The publication of these general criteria and procedures for direct awards does not constitute a call for bids or a request for proposals.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bbf3cbf elementor-widget__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"bbf3cbf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Eligibility Criteria<\/strong><\/p><p>Depending on the specific scope of services, the following requirements, in particular, may be taken into account:<\/p><ul><li>Professional and technical expertise<\/li><li>Relevant experience and suitable reference projects<\/li><li>Sufficient personnel and organizational capacity<\/li><li>Demonstrable experience with comparable services<\/li><li>Professional and reliable service delivery<\/li><li>Compliance with legal, data protection, and technical requirements<\/li><li>Where applicable, status as a media service provider or online platform provider as defined by the EMFA<\/li><\/ul><p>\u00a0<\/p><p>SAL may request appropriate supporting documentation, such as company information, references, reach or target audience data, work samples, technical documentation, or details regarding the proposed project teams.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a97467c elementor-widget__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"a97467c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Reasons for Selecting the Company - Evaluation of Proposals<\/strong><\/p><p>The evaluation is conducted based on the relevant criteria for each specific contract. In particular, the following aspects may be taken into account:<\/p><p><strong>1. Price and Cost-Effectiveness<\/strong><\/p><ul><li>Total price or total costs<\/li><li>Reasonableness and transparency of pricing<\/li><li>Balance between costs, quality, reach, and expected impact<\/li><li>Long-term cost-effectiveness and follow-up costs<\/li><\/ul><p>\u00a0<\/p><p><strong>2.
